Annulment vs. Nullity of Marriage

Knowing the Differences

Annulment
Marriage is valid until otherwise ordered by the court.
The grounds for voidable marriages are found under Article 45 of the Family Code of the Philippines.

Nullity
From the very beginning, the marriage cannot be valid due to the lack of its essential and formal requisites (Article 2 & 3, Family Code of the Philippines).
The grounds for Void Marriages are found under Article 35-44 of the Family Code of the Philippines.

Grounds for Annulment and Nullity of Marriage (Article 45, Family Code)
Marriages between parties who are 18-21 years old without parental consent.

That either party was of unsound mind.

Consent of either party was obtained by force, intimidation, undue influence, or fraud.

Either party is physically incapable of consumation or is afflicted with a sexually transmitted disease found to be serious and appears to be incurable.

Grounds for Nullity of Marriage:
Parties to the marriage are below 18 years of age.
Those married by any person who does not have legal authority to do so.
Psychological incapacity of either of the contracting parties
Incestuous marriages between the realtionship of parties whether it be legitimate or illegitimate
Marriages contrary to public policy
Bigamous or polygamous marriages, with exemptions.
Other marriages which lack the essential and formal requisites
